Mysway ("Mysway", "we", "us", "our") operates a performance-first creator marketing platform available at mysway.co(the "Platform"). The Platform enables businesses ("Brands") to launch paid content campaigns and connects them with social media creators ("Creators") who publish sponsored content on third-party platforms such as TikTok, Instagram, and YouTube, and receive payouts based on verified performance.
By creating an account, connecting a social account, funding a wallet, submitting content, or otherwise using the Platform, you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Platform.
You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. We may suspend or terminate accounts that violate these Terms, applicable law, or our partners' policies (including the platform policies of TikTok, Meta, and Google).
The Platform allows Brands to create campaigns and Creators to discover, accept, and fulfill them. Mysway is a neutral intermediary: we facilitate discovery, publishing automation, performance measurement, escrow of campaign funds, and payouts. We are not a party to the underlying creative engagement between Brand and Creator and do not guarantee specific results.
When you connect a TikTok, Instagram, or YouTube account, you authorize Mysway to read public profile and content metrics and, where you have explicitly opted in, to publish content on your behalf via the official APIs of those platforms. You remain bound by the terms of each connected platform. You may disconnect at any time from your Connections page; disconnection does not affect payouts already earned for verified performance.
Brands are responsible for ensuring their campaign briefs comply with applicable advertising, consumer-protection, and intellectual-property laws. Creators are responsible for the content they publish and must clearly disclose sponsored content in line with FTC, ASA, ACMA, and equivalent rules. Content must not be unlawful, deceptive, defamatory, discriminatory, sexually explicit, or infringing. Mysway may reject, remove, or refuse to pay out on content that violates these Terms or a Brand's brief.
Brand wallets are funded via Stripe. Funds added to a Brand wallet are held by our payment processor and applied against campaign performance as verified by Mysway. Creator earnings accrue as performance is verified (typically on a 12-hour refresh) and are paid out on request, subject to identity and tax verification and a minimum payout threshold. Mysway charges a platform fee disclosed at the time of campaign creation. All amounts are denominated in USD unless stated otherwise. Chargebacks, fraud, or violations of these Terms may result in withheld or reversed payouts.
Wallet top-ups are non-refundable except where required by law or where a top-up has not yet been applied to a campaign and a written refund request is made within 30 days. Taxes are your responsibility.
Creators retain ownership of content they create. By submitting content to a campaign, Creator grants the Brand a non-exclusive, worldwide license to use, reproduce, and display the content for the purposes set out in the campaign brief. Brands retain ownership of their trademarks and brand assets and grant Creators a limited license to use them solely to fulfill the campaign. Mysway retains all rights in the Platform itself.
You agree not to: (a) inflate metrics through bots, click-farms, or fraudulent engagement; (b) reverse engineer, scrape, or interfere with the Platform; (c) misrepresent your identity or audience; (d) bypass campaign safeguards; or (e) use the Platform to violate any third-party platform's terms.
The Platform is provided "as is" and "as available". We disclaim all implied warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific campaign outcome, reach, or revenue.
To the maximum extent permitted by law, Mysway's aggregate liability arising out of or relating to these Terms or the Platform will not exceed the greater of (i) the platform fees paid by you to Mysway in the 12 months preceding the claim, or (ii) USD 100. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
You may stop using the Platform at any time. We may suspend or terminate access for breach of these Terms, suspected fraud, or risk to the Platform. Sections that by their nature should survive termination (IP, disclaimers, liability, payment obligations) will survive.
We may update these Terms from time to time. Material changes will be notified via the Platform or by email. Continued use of the Platform after a change takes effect constitutes acceptance.
These Terms are governed by the laws applicable at Mysway's principal place of business, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts located there, except where applicable consumer law grants you the right to bring proceedings elsewhere.
